By accessing our website, using our services, or purchasing any product or service from Music Ark, you fully agree to these Terms. If you do not accept or agree with any part of these Terms, you must immediately cease use of our website and services.

3. Use of Our Website & Services
You agree to use our website and services lawfully and in accordance with French and European law, including (but not limited to):
Not uploading, sharing, or transmitting any content that is illegal, defamatory, abusive, obscene, fraudulent, or that violates intellectual property rights.
Not attempting to hack, disrupt, or unlawfully access our systems, servers, or website.
Not using our website content (including text, images, audio samples, music previews, or branding) for any commercial or unlawful purpose without prior written consent from Music Ark.
We reserve the right to suspend or terminate any user account or service agreement if we detect or suspect misuse.
4. Purchases, Pricing & Payment
a. Pricing
All prices listed on our website are inclusive of applicable VAT where required under EU law, unless explicitly stated otherwise. Prices are subject to change without notice, but services already purchased will be delivered at the agreed price at the time of order confirmation.
b. Payment Methods
We accept payments through secure third-party processors such as Stripe and PayPal, who comply with PCI-DSS security standards. By purchasing a service, you agree to their respective terms of service in addition to these Terms.
c. Order Confirmation
A legally binding contract is formed between you and Music Ark upon receipt of payment and issuance of an order confirmation email from us. Please keep a copy of this confirmation for your records.
5. Cancellation & Refund Policy
a. Custom and Creative Services
Due to the highly customized and creative nature of our services, all sales are final unless otherwise agreed in writing. Refunds may only be issued at our sole discretion if:
We are unable to deliver the agreed service due to reasons attributable solely to Music Ark.
The service has not yet commenced, and cancellation is requested within 14 days of purchase, in accordance with Article L221-18 of the French Consumer Code, provided the service delivery has not started.
b. Exception for Consumers (EU Right of Withdrawal)
If you are a consumer residing in the EU, you have a statutory right to withdraw from a service contract within 14 days of purchase, unless you have explicitly waived this right by agreeing to immediate performance (e.g., immediate commencement of work).
6. Ownership, Licensing & Intellectual Property
a. Custom Work
Exclusive Compositions: Upon full payment, you are granted a perpetual, exclusive license to use the composition for commercial and non-commercial purposes, subject to any restrictions in your order confirmation.
Non-Exclusive Compositions: You are granted a limited, non-exclusive, revocable license to use the composition, subject to applicable licensing terms.
Music Ark retains moral rights (droit moral) as recognized under French copyright law.
b. Beats & Instrumentals
Exclusive Beats: Full usage rights are transferred to the purchaser upon payment, but Music Ark retains the right to showcase the work in our portfolio and for promotional purposes.
Non-Exclusive Beats: You are granted a non-exclusive license, and Music Ark retains ownership and the right to license the beat to other clients.
c. Demo Submissions
By submitting a demo, you grant Music Ark a royalty-free, non-exclusive license to evaluate, store, and review the submission for potential collaboration.
No ownership of submitted works transfers to Music Ark unless mutually agreed under a separate written agreement.
7. Intellectual Property (Website & Branding)
All website content, branding, logos, text, images, and audio previews are the exclusive property of Music Ark and protected by French and EU copyright laws. Unauthorized reproduction, distribution, or modification is strictly prohibited.
8. Client Responsibilities
For all custom services, you agree to:
Provide clear creative briefs, references, and required materials.
Respond promptly to requests for feedback and approval.
Use delivered content only for lawful purposes.
Failure to cooperate in a timely manner may result in project delays or cancellation, without refund.
9. Revisions Policy
All packages include a specified number of revisions, which apply only to reasonable creative adjustments. Major changes (e.g., complete style changes or reworks) are subject to additional fees.
10. Limitation of Liability
a. Service Quality
We commit to providing all services with reasonable skill and care, but:
We do not guarantee any specific commercial results, streaming performance, or public reception.
We are not liable for indirect, incidental, special, or consequential damages related to the use of our services.
b. Technical Issues
We are not responsible for delays or failures caused by:
Internet or technical failures beyond our control.
Force majeure events (natural disasters, strikes, government action, etc.).
c. Liability Cap
Our total liability under any contract shall not exceed the total amount paid for the specific service in question.
11. Third-Party Links
Our website may contain links to third-party websites or platforms (Spotify, Instagram, YouTube). Music Ark is not responsible for the content, security, privacy practices, or policies of these third parties.
12. Data Protection & Privacy
Music Ark processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and French Loi Informatique et Libertés.
